BranDig reserves the right to modify these Terms at any time, without notice to you, by posting the modified Terms on the Service. Your continued use of the Service after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by the modified Terms. You must provide accurate and complete registration information like name, mobile number, email ID, etc. ("Personal Data"). By providing us with the same, you acknowledge and accept that we have your consent for the collection and processing of such Personal Data. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to immediately notify BranDig of any unauthorised use, or suspected unauthorised use, of your account or any other breach of security. BranDig is not liable for any loss or damage arising from your failure to comply with this provision.

Intellectual Property Rights

1. The Service, including its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), is owned by BranDig or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:
   • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
   • You may store files that are automatically cached by your web browser for display enhancement purposes.
   • You may print or download one copy of a reasonable number of pages of the Service for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
2. The user may not use the BranDig platform for any illegal or unauthorised purpose, including but not limited to violating any intellectual property rights, engaging in fraudulent activities, or transmitting viruses or other harmful code

Some content on the BranDig platform is user generated over which we do not exercise editorial control, we may, in appropriate circumstances and at our sole discretion subject to applicable law, delete such content, or block, delete, and/or take other appropriate steps relating to the accounts of users who may be infringers.

Third-Party Links and Content

The Service may contain links to third-party websites, advertisers, or services that are not owned or controlled by BranDig. BranDig has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites.

Indemnification

You agree to indemnify and hold BranDig, its affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your use of BranDig, your violation of the Terms, or your violation of any rights of another, any User Content submitted or posted by you on the platform in violation of these Terms of Use, fraud you commit or your intentional misconduct or gross negligence.

You are solely responsible for your interactions with merchants as well as other users on the platform. To the extent permitted under applicable laws, you hereby release BranDig from any and all claims or liability related to any product or service of a merchant, without limitation, but not limited to any harm caused to you by action or inaction of a merchant, a merchant’s failure to comply with applicable law and any conduct, speech or User Content, whether online or offline, of any other third-party.

Grievance Redressal

BranDig is not liable for any infringement of copyright arising out of materials posted on or transmitted through the site, or items advertised on the site, by end users or any other third parties. Termination

1. We are constantly innovating, changing and improving the Services. We may, without notice, add or remove functionalities or features, create new limits to the Services, or temporarily or permanently suspend or stop a Service.

BranDig may terminate or suspend your access to all or part of the Service, without notice, for any conduct that BranDig, in its sole discretion, believes is in violation of these Terms or any applicable law or is harmful to the interests of another user, a third-party provider, a service provider, or BranDig itself.

Miscellaneous

1. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
2. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and BranDig’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
3. You agree that any cause of action arising out of or related to these Terms or the Service must commence within six (6) months after the cause of action accrues. Otherwise, such cause of action is permanently barred.
4. These Terms constitute the entire agreement between you and BranDig and govern your use of the Service, superseding any prior agreements between you and BranDig. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other BranDig services, affiliate services, third-party content, or third-party software.
5. If there is a conflict or inconsistency between the terms in this document and the additional terms associated with a particular Service, the additional terms will control solely for that conflict or inconsistency.
6. BranDig may assign these Terms, in whole or in part, at any time without notice to you. You may not assign these Terms or transfer any rights to use the Service.

Force Majeure

BranDig shall not be liable for any delay or failure to perform its obligations under these terms and conditions if such delay or failure is due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or strikes.

1. BranDig does not endorse any brand or store, nor does it guarantee the authenticity, quality, safety or legality of any product, service or content provided by any brand or store.
2. BranDig does not guarantee the accuracy, completeness or timeliness of the information provided on the website or mobile app, and is not responsible for any errors, omissions, or inaccuracies in the information provided.
3. BranDig is not responsible for any technical issues or errors that may occur while using the BranDig platform, including but not limited to internet connectivity issues, software bugs, and errors. BranDig is also not liable for any losses or damages that may result from such technical issues or errors.
4. BranDig is not liable for any damages, including but not limited to direct, indirect, incidental, special, punitive, or consequential damages arising from the use of the website or mobile app, or any content, product or service provided by any brand or store listed on the website or mobile app
5. BranDig does not endorse or take responsibility for any user-generated content posted on the website or mobile app, including but not limited to reviews, recommendations or check-ins.
6. The user agrees that any information or content submitted by the user to the BranDig platform, including but not limited to reviews, ratings, and comments, may be used by BranDig for promotional and marketing purposes without any obligation to compensate the user.
7. You Understand And Agree That No Data Transmission Over The Internet Or Information Storage Technology Can Be Guaranteed To Be Secure, And BranDig Expressly Disclaims Any Warranties, Express Or Implied, To That Effect.

Governing Law and Dispute Resolution

1. Any dispute, differences or claim arising out of or in connection with or in relation thereto the BranDig Platform, the Terms, relating to or in connection with these Terms, or any content uploaded on the BranDig Platform or the relationship between User and BranDig shall be governed by and construed in accordance with the laws of India.
2. Any dispute, controversy or claim arising out of or relating to these terms and conditions, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996
3. The arbitration shall be conducted by a single arbitrator appointed by mutual agreement of the parties. If the parties are unable to agree on the arbitrator within 30 days of the initiation of the arbitration, the arbitrator shall be appointed by the President of the Indian Council of Arbitration.
4. The arbitration shall be subject to the exclusive jurisdiction of the courts of Hyderabad, India and the language of the arbitration shall be English.
5. The award rendered by the arbitrator shall be final and binding on the parties.
6. The parties shall bear their own costs of the arbitration, unless the arbitrator decides otherwise.

Limitation of Liability

1. In no event shall BranDig or its affiliates, partners, officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, treble or other multiples of damages, exemplary or punitive damages, including but not limited to, damages for loss of profits or revenue, lost business opportunities, lost business opportunities, diminution in value, including any alleged loss or diminution in value of personal information, goodwill, use, data or other losses (even if BranDig has been advised of the possibility of such damages), arising out of or in connection with THESE TERMS or your use of or inability to use the Service or any content, services, or products provided on or through the Service, whether based on warranty, contract, tort, or any other legal theory, and whether or not BranDig is advised of the possibility of such damages or in connection with: the deletion of, alteration of, mis-delivery of, or failure to store data maintained or transmitted by the services; the limiting, suspension or termination of your account; your downloading or sharing of information, including personal information, via the services; the unauthorised access to your account or any data maintained or transmitted by the services; links provided by the services or third parties to external sites or resources; your dealings with or participation in promotions of advertisers found on or through the services; or any good or services sold by such advertisers
2. BranDig entities will not be liable for problems caused by others, the wrongful or unlawful actions of third parties, or an act of god. The limitations and exclusions in these terms will apply whether or not branDig has been advised of or should have been aware of the possibility of any losses arising.
3. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law

Feedback

You agree that any recommendation, idea, proposal, suggestion, feedback or other input (“Feedback”) you submit to BranDig related to its services, websites, apps, or technology may be used by BranDig without any notice, obligation, restriction, reimbursement or compensation to you and you waive (or agree not to enforce) any and all rights that may now or in future exist (including moral and equivalent rights) in any Feedback.

Entire Agreement

These Terms of Use and any policies or operating rules posted by us on the Service constitute the entire agreement and understanding between you and BranDig and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and BranDig (including, but not limited to, any prior versions of the Terms of Use).

Assignment

You may not assign or delegate any rights or obligations under the Terms of Use without BranDig's prior written consent, and any unauthorised assignment and delegation by you is void and ineffective. BranDig may assign or delegate its rights and obligations under the Terms of Use without your consent.

Waiver

Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights. If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in effect.

The user agrees to receive communications from BranDig, including but not limited to emails, text messages, and push notifications. The user can opt-out of receiving these communications at any time by adjusting their notification settings

Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms and Conditions, will be in writing and given by us via email or by posting to our Service. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

The headings in these terms and conditions are for convenience only and shall not affect the interpretation of these terms and conditions.
